By accessing divinesainik.com, evaluating software artifacts, provisioning an operator node, or deploying DIVINE SAINIK edge models on customer hardware, you explicitly consent to and agree to be legally bound by these Terms and Conditions.
01. Scope & Platform Classification
OPERATIONAL SCOPEDIVINE SAINIK (“Company”, “we”, “our”) operates as an independent deep-technology company engineering sovereign artificial intelligence systems, computer vision perception runtimes, and real-time defense sensor fusion architectures.
These Terms govern: (a) public interaction with the divinesainik.com web domain; (b) simulated Command & Control (C2) interactive evaluation terminals; (c) proprietary model runtime binaries, TensorRT execution plans, and zero-WAN demuxing containers; and (d) technical pilot evaluations deployed within customer air-gapped server environments.
02. Intellectual Property & Neural Weights
PROPRIETARY ASSETSAll software components—including low-level CUDA kernels, TensorRT INT8 quantization engines, spatial Kalman tracker pipelines, synthetic sensor simulation datasets, system architecture diagrams, and military-specification interface layouts—remain the exclusive intellectual property of DIVINE SAINIK.
Users and evaluation operators shall not: (i) reverse engineer, disassemble, or decompile runtime binaries; (ii) extract or harvest neural model weights from volatile GPU memory buffers; (iii) clone, repackage, or create derivative perception engines without executed bilateral written authorization; or (iv) bypass hardware TPM 2.0 cryptographic licensing handshakes.
03. Evaluation Licenses & PoC Deployment
TIME-BOUND POCWhere DIVINE SAINIK grants an operator evaluation node or Proof-of-Concept (PoC) license:
- Limited License: Grants a non-exclusive, non-transferable, revocable license strictly for internal technical validation within agreed site boundaries.
- Time Bound: Evaluation licenses automatically expire upon conclusion of the specified PoC timeframe (typically 30 to 90 days) unless converted into an Enterprise Deployment Agreement.
- Benchmarking Disclosure: Independent performance benchmark reports or stress-test results may not be publicly distributed without mutual prior written clearance.
04. Air-Gapped Zero-WAN Operational Mandate
ZERO EGRESSDIVINE SAINIK systems are engineered to operate in physically disconnected, air-gapped enclaves:
05. Sovereign Compliance & SCOMET Controls
EXPORT COMPLIANCEDIVINE SAINIK software comprises dual-use and defense-relevant technology subject to Indian Foreign Trade Policy, including Special Chemicals, Organisms, Materials, Equipment and Technologies (SCOMET) guidelines.
Licensees shall not directly or indirectly export, re-export, transfer, or release any software binary, encrypted weights, or design artifacts to any foreign entity or designated embargoed destination without explicit government clearances from the Ministry of Commerce & Industry (DGFT) and the Ministry of Defence, Government of India.
06. Sensor Ingestion & Decision Disclaimers
OPERATIONAL BOUNDARIESDIVINE SAINIK provides deterministic spatial awareness, automated anomaly bounding boxes, and real-time perimeter alert vectors. The platform operates strictly as a decision-support and visual intelligence tool.
Final kinetic actions, physical intervention measures, gate locks, or weaponized deterrence deployments remain the sole operational prerogative and liability of the designated human command authority or designated military/security personnel.
07. Warranties & Limitation of Liability
LIABILITY LIMITSExcept as expressly provided in a signed Master Defense Agreement, the platform is supplied on an “AS IS” and “AS AVAILABLE” basis for website previews and trial evaluation. To the maximum extent permitted by applicable Indian law:
- DIVINE SAINIK disclaims all implied warranties of merchantability, fitness for a particular physical site layout, or uninterrupted optical availability under catastrophic weather or extreme optical occlusion.
- In no event shall DIVINE SAINIK be held liable for indirect, punitive, special, or consequential damages resulting from unauthorized hardware tampering, sensor miscalibration, or unapproved third-party ONVIF camera protocol deviations.
08. Bilateral NDA & Classified Data Custody
CONFIDENTIALITYBoth parties agree that all confidential information exchanged—including site coordinate telemetry, optical camera topological maps, threat scenario scripts, and performance benchmarks—shall be safeguarded under executed Bilateral Non-Disclosure Agreements (B-NDA).
DIVINE SAINIK team members with site access operate under sovereign background verification standards and are bound by statutory secrecy obligations.
09. Governing Law & Dispute Resolution
NEW DELHI JURISDICTIONThese Terms shall be interpreted and enforced solely in accordance with the substantive laws of the Republic of India.
Any dispute arising out of or related to these Terms shall be resolved exclusively through binding arbitration in New Delhi, India, in accordance with the Arbitration and Conciliation Act, 1996, conducted in the English language before a sole arbitrator appointed by mutual consent. The courts in New Delhi shall have exclusive territorial jurisdiction.
